ORDINANCE No. 6 of 1865.

Forgery.

Warrant of any Justice of the Peace, or any Recognizance purporting to have been entered into before any Justice of the Peace, or other Officer authorized to take the same, or any Examination, Deposition, Affidavit, Affirmation, or solemn Declaration, taken or made before any Justice of the Peace, or any Commissioner appointed to administer Oaths, shall be guilty of Felony, and being convicted thereof shall be liable, at the Discretion of the Court, to be kept in Penal Servitude for the Term of Three Years, or to be imprisoned for any Term not exceeding Two Years, with or without Hard Labour, and with or without Solitary Confinement.

As to forging Official Signatures.

XXXIII. Whosoever, with Intent to defraud, shall forge or alter any Certificate, Report, Entry, Licence, Permit, Indorsement, Direction, Authority, Instrument, or Writing, made or purporting or appearing to be made by the Governor, or Colonial Secretary, or by the Colonial Treasurer, Auditor-General, or any Officer of Customs, or by any Officer of any Court in this Colony, or the Name, Handwriting, or Signature of the Governor, Colonial Secretary, Colonial Treasurer, Auditor-General, Officer of Customs, or Officer, as aforesaid, or shall offer, utter, dispose of, or put off any such Certificate, Report, Entry, Licence, Permit, Indorsement, Direction, Authority, Instrument, or Writing, knowing the same to be forged or altered, shall be guilty of Felony, and being convicted thereof shall be liable, at the Discretion of the Court, to be kept in Penal Servitude for any Term not exceeding Fourteen Years and not less than Three Years, or to be imprisoned for any Term not exceeding Two Years, with or without Hard Labour, and with or without Solitary Confinement.

Acknowledging Recognizance, Bail, &c., in Name of another.

XXXIV. Whosoever, without lawful Authority or Excuse (the Proof whereof shall lie on the Party accused), shall, in the Name of any other Person, acknowledge any Recognizance or Bail, or any Judgment, or any Deed or other Instrument, before any Court, Judge, or other Person lawfully authorized in that Behalf, shall be guilty of Felony, and being convicted thereof shall be liable, at the Discretion of the Court, to be kept in Penal Servitude for any Term not exceeding Seven Years and not less than Three Years, or to be imprisoned for any Term not exceeding Two Years, with or without Hard Labour, and with or without Solitary Confinement.

As to forging Marriage Licences.

XXXV.
